High Density Housing / Commercial - Addition / Alteration - Outdoor Patio - To install a patio for the existing Restaurant - class 1 (Pho 99) on the site. Proposed 22 outdoor seats, total occupant load is 118 persons including staff. Building Review Branch Notes: - See DB-2016-02212 for related restaurant. - Maximum Occupant Load: 118 persons (interior 86 seats plus 10 staff, exterior 22 seats) - A permanent sign indicating the above maximum occupant load shall be posted in a conspicuous location. - All signage to have separate sign permits. - At least one accessible seating area shall be provided. Development Review Branch Notes: 1. The outdoor patio of 22 seats is for the exclusive use of Pho 99, unless otherwise permitted by the Director of Planning. If the tenant ceases to exist, Planning may wish to seek additional information regarding the new tenant space and potentially a new application if they wish to utilize this outdoor patio. 2. The outdoor seating area is to be closed and cleared of customers by 11:00 p.m. nightly. 3. There is to be no amplified music or live entertainment on the outdoor seating area at any time. 4. The outdoor seating area must comply with the applicable provisions of the Health By-law, smoking in and around the outdoor seating area is not permitted. 5. Maximum number of seats for the outdoor seating area is 22.
