Note: This appeal was heard by the Board of Variance on August 28th, 2018 and was ALLOWED IN PART, thereby granting relaxations of the Rear Yard, Floor Space Ratio and Building Depth regulations of the RS-1 District Schedule and approved a covered sundeck at this existing one-family dwelling site, subject to the following conditions: (1) that the approval is for the exclusive use of Hitu Jethi, Sandeep Jethi, Prem N. Jethi and Surjit Jethi (and includes their family members) in accordance with the Board’s decision on August 28th, 2018; (2) that the approved cover shall be limited to the sundeck area only, and cannot cover the sunken patio areas (the sunken patio areas must be ‘open to sky’ and uncovered); and (3) that the development shall otherwise comply with the requirements and regulations of the Zoning and Development By-law to the satisfaction of the Director of Planning.
